DREAM WINDOW MAKEOVER SWEEPSTAKES

Official Rules

1.     NO PURCHASE NECESSARY.

NEITHER PURCHASE OF A PRODUCT OF SERVICES, NOR ANY MONETARY PAYMENT, WILL INCREASE YOUR ABILITY TO WIN OR IS REQUIRED TO ENTER.

2.     Sponsor and Eligibility. The Sponsor of this Dream Window Makeover Sweepstakes (“Sweepstakes”) is Leaf Home Enhancements, LLC, dba Miracle Windows, having a place of business at 1595 Georgetown Road, Hudson, Ohio 44236 (“Sponsor”). The Sweepstakes is only open to legal residents of the United States, who, at the time of entering the Sweepstakes, are (a) 18 years of age or older and (b) a Qualifying Homeowner (as such term is hereinafter defined) in specified Zip Codes in the state of Florida (“Eligible Location”).  A list of Zip Codes in the Eligible Location can be found on the Landing Page (as defined herein).

The Sweepstakes is void where prohibited by law. Employees of Sponsor and its affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is governed by (i) these official rules (“Rules”), and (ii) subject to all applicable federal, state, and local laws and regulations.

The Sweepstakes consists of one (1) drawing (as specified below) and is designed to give eligible entrants the opportunity to win the Prize (as defined herein) in accordance with these Rules.

For the purposes of these Rules, the term “Qualifying Homeowner” means a person who, at the time of entry in the Sweepstakes, owns a home with at least three (3) exterior impact windows in the Eligible Location.

For purposes of these Rules, the term “Landing Page” means the URL of /giveaway-terms/.

3.     Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules and Sponsor’s Privacy Policy, which can be found at https://privacy.leafhome.com, at time of entry, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the Sweepstakes.

4.     Sweepstakes Period: The Sweepstakes will run in the Eligible Location from June 17, 2024 to December 15, 2024 (the “Sweepstakes Period”).  Entries (as defined herein) will be accepted starting on June 17, 2024 at 8:00am ET and ending on December 15, 2024 at 11:59pm ET.  All Entries must be received by December 15, 2024, 11:59pm ET.  Sponsor’s computer is the official Sweepstakes clock.

5.     How to Enter:  

Text Entry: You may enter the Sweepstakes during the applicable Sweepstakes Period by texting a keyword to 373737.

Mail-in Entry: You may also mail your entry to: Dream Window Makeover Sweepstakes, 1595 Georgetown Road, Hudson, OH 44236. Mailed entries must contain your name, address, telephone number, and a simple statement affirming your desire to be entered into the Sweepstakes (“Mail-in Entry” together with Online Entry, an “Entry”).

The Entry must fulfill all Sweepstakes requirements and the Winner (as defined herein) must satisfy all eligibility requirements, as specified herein, to be eligible to win a Prize (as defined herein). Entries that are not complete or do not adhere to these Rules may be disqualified at the sole discretion of Sponsor. You may enter only once, and you must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these Rules. If you use fraudulent methods or otherwise attempt to circumvent these Rules, your Entry may be removed from eligibility at the sole discretion of Sponsor.

6.     Prize: One (1) winner will receive new impact windows and installation of such windows for their home in the Eligible Location, up to and not exceeding a total retail value of $25,000.00 (“Prize”). Actual or appraised value may differ at time of Prize award. The specifics of the Prize shall be solely determined by the Sponsor, and Sponsor reserves the right to substitute another prize of equal or greater value. The Prize is non-transferable. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. No substitution of the Prize or transfer or assignment of the Prize to others or request for the cash equivalent by Winner is permitted. Acceptance of the Prize constitutes permission for Sponsor to use the Winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

7.     Odds: The odds of winning depend on the number of eligible Entries received.

8.     Taxes: Any valuation of the Prize stated above is based on available information provided to the Sponsor, and the value of the Prize awarded to the Winner may be reported to the IRS as required by law. The Winner is solely responsible for reporting and paying any and all applicable federal, state, and local taxes, related to acceptance and use of the Prize. The Winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before the Prize will be awarded. Any person winning over $600 in prizes from the Sponsor in a calendar year will be issued an IRS Form 1099 reporting the value of those prizes to the IRS.

9.     Winner selection and notification: On or about December 31, 2024, one (1) Winner will be selected by a random drawing of all eligible Entries received during the Sweepstakes Period in the applicable Eligible Location by Sponsor’s representative or designee, whose decisions shall be final and binding in all respects. The Winner will be notified via phone to the telephone number provided in the Winner’s Entry within five (5) days following the applicable winner selection. Sponsor shall have no liability for Winner’s failure to receive notices due to the Winner’s spam or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information. If a selected winner cannot be contacted, is ineligible, fails to claim the Prize within five (5) calendar days from the time award notification was sent, or fails to timely return a completed and executed Affidavit of Eligibility and Release as required by Sponsor, such winner shall forfeit the Prize and Sponsor will select an alternate winner by random drawing from among all remaining eligible Entries.  

The acceptance by the Winner of the Prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE RULES BY THE WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

10.  Certain Conditions: The Winner must satisfy all eligibility requirements stated herein and be available ON OR BEFORE January 31, 2025, to allow Sponsor’s personnel to inspect Winner’s premises and determine that the Prize can be installed. If the Prize cannot be installed at Winner’s premises, the Winner forfeits the Prize and another Winner from the applicable Eligible Location will be selected. The Winner and Sponsor’s personnel will agree on a mutually acceptable installation date, provided such installation shall be performed no later than June 30, 2025.

11.   Rights Granted by You: By entering this Sweepstakes you understand that Sponsor or anyone acting on behalf of Sponsor or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your Entry, and your name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

12.  Elimination and Termination: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes should (in its sole discretion) a virus, bug, non-authorized human intervention, fraud or other cause beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Sponsor may select the Winner from all eligible Entries received in the Eligible Location prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Rules.

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void Entries for any reason, including, but not limited to: multiple Entries from the same user from different IP addresses; multiple Entries from the same computer in excess of that allowed by these Rules; or the use of bots, macros or scripts or other technical means for entering. 

Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made; Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

By entering the Sweepstakes, you agree to receive email newsletters, promotional materials, and telephone solicitations periodically from Sponsor and its subsidiaries, affiliates, agents, or representatives. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter or requesting no further contact.

13.  Limitation of Liability: By entering, you agree to release Sponsor and its subsidiaries, affiliates, advertising and Sweepstakes agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (together with Sponsor, the “Released Parties”) from any and all liability, illness, injury, death, loss, litigation, claim or damage (including punitive, incidental, and consequential damages) or expense (including attorneys’ fees) that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of Entries.

The Released Parties will not be responsible for: late, incomplete, or incorrect entries; your failure to receive Prize notices due to your spam, junk e-mail, or other security settings or for your provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the Prize. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor reserves the right to cancel or modify this Sweepstakes in a manner deemed appropriate by the Sponsor. In the event of termination, Winner will be selected from among all eligible Entries in the applicable Eligible Location received as of date of termination. In the event a dispute arises as to the identity of a potentially winning participant, Entries will be declared made by the name on the Entry form.

BY ENTERING, YOU SPECIFICALLY AND KNOWINGLY WAIVE ANY RIGHT TO A TRIAL BY JURY, AND A TRIAL BY JURY IS HEREBY WAIVED BY BOTH YOU AND SPONSOR. YOU UNDERSTAND THAT YOU ARE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND, AND HEREBY EXPRESSLY WAIVE, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE, COUNTRY OR TERRITORY, WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

14.  Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND OHIO WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, you agree that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ohio having jurisdiction. Further, in any such dispute, under no circumstances shall you be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses. You further waive all rights to have damages multiplied or increased.

15.  Warranty and Indemnity:  Each entrant represents and warrants that their Entry is original, that they are the sole and exclusive owner and right holder of the submitted Entry, and that they have the right to submit the Entry in the Sweepstakes. Each entrant further represents and warrants that their Entry does not (1) infringe any third party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; (2) include any personally identifiable information of any person other than entrant; or (3) otherwise violate any applicable law.  To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified the Released Parties at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the Released Parties may become liable by reason of or related or incidental to any act, default or omission by an entrant under these Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission, whether negligent or otherwise, of these Rules by an entrant.

16.  No Third-Party Sponsor: This Sweepstakes is in no way sponsored, endorsed, or administered by, or in association with any person or other entity, including any third party, other than Sponsor. NAMES, LOGOS AND OTHER MATERIALS ARE USED FOR PURPOSES OF SWEEPSTAKES AND/OR PRIZE DESCRIPTION ONLY. ALL TRADEMARKS, SERVICE MARKS, TRADE NAMES, TRADE DRESS, PRODUCT NAMES AND LOGOS APPEARING IN THE SWEEPSTAKES ARE THE PROPERTY OF THEIR RESPECTIVE OWNERS; USE DOES NOT IMPLY AFFILIATION OR ENDORSEMENT.

17.  Severability:  If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

18.  Winners List: To obtain a copy of the Winner’s name or a copy of these Rules, mail your request to: Leaf Home Enhancements, LLC, dba Storm Tight Windows, 1595 Georgetown Road, Hudson, Ohio 44236.  Requests must be received no later than June 30, 2025.
